2. Scope
These terms govern the use of ilgozzosalerno.com and the services you can request through it: booking a table, buying gift vouchers and asking for takeaway. Anyone buying a voucher accepts them by ticking the box before payment.
3. Booking a table
Booking through the site is free and requires no advance payment, except on the dates listed below.
The confirmation email constitutes acceptance of the booking. We ask you to reply to the reminder we send the day before to confirm you are coming.
To cancel or change, reply to the confirmation email or message us on WhatsApp. Please give us at least 3 hours’ notice so we can offer the table to someone else.
We hold the table for 15 minutes past the booked time. Beyond that, if you have not told us, we may not be able to keep it.
4. Dates with a deposit, and no-shows
On 15 August, 24, 25 and 31 December and 1 January, a booking is confirmed only once a deposit of €20 per person has been paid. It is requested separately after you submit the form, through a payment link sent on WhatsApp.
The deposit is deducted in full from your bill at the time of service.
If you cancel at least 24 hours before the booked time, the deposit is refunded in full within 14 days. If you do not show up without cancelling, or cancel later than that, the deposit is retained as compensation for the unused table.
This condition must be expressly accepted when booking, using the dedicated checkbox: without that acceptance a booking on those dates cannot be confirmed.
5. Gift vouchers
Vouchers are valid for 12 months from the date of purchase; the expiry date is printed on the voucher.
Show the voucher before ordering, printed or on your phone. It is used once and for its full value: it cannot be split and gives no right to change in cash.
It is transferable. It is neither refundable nor exchangeable for cash, except for the right of withdrawal described below.
If you lose it, we can reissue it: write to us with the code or the email used to buy it.
6. How to buy a voucher
Vouchers are bought on the gift voucher page: choose the voucher and quantity, enter your details and, if it is a gift, the recipient’s, accept these terms and pay with PayPal or by card.
Before paying you see the total and can correct any detail in the form; the PayPal window shows the amount again before you confirm.
The contract is concluded when PayPal confirms the payment. Straight afterwards we email you the voucher, with its code and expiry date, and a summary of the conditions: that email is your purchase confirmation and it is worth keeping. The contract is not kept available on the site, but we will send you a copy on request.
If PayPal holds the payment for review, the voucher arrives as soon as the payment is confirmed. If the payment fails, you are not charged anything.
These terms are published in Italian and English; in case of any discrepancy the Italian version prevails.
7. Right of withdrawal
Gift vouchers are bought at a distance: if you are a consumer you may withdraw within 14 days of purchase without giving any reason (Arts. 52 ff. of the Italian Consumer Code). An explicit statement sent to info@ilgozzosalerno.com is enough, and you may use the form in the next section.
We refund the full amount without undue delay and in any case within 14 days of the day we receive your statement, using the same means of payment as the purchase and at no cost to you.
If you use the voucher before the 14 days have passed, you are asking for the service to be performed: once the service has been fully provided, the right of withdrawal can no longer be exercised (Art. 59(a) of the Consumer Code).
A table booking is a restaurant service for a specific date: by law it is not subject to the right of withdrawal (Art. 59(n) of the Consumer Code). The cancellation conditions set out above still apply.
8. Withdrawal form
Complete and return this form only if you wish to withdraw from the purchase of a voucher (Annex I, Part B, Italian Consumer Code). You may also write to us in your own words.

9. Payments
Gift voucher payments are handled by PayPal, with a PayPal account or with a credit or debit card. Card details never pass through our website.
All prices include VAT.
10. Takeaway
Takeaway is available on request via WhatsApp, during opening hours and within what the kitchen can prepare at that moment. It is not an automated ordering service: availability and timing are confirmed in the chat before anything is prepared.
11. Menu, prices and allergens
The menu published on the site reflects the restaurant's card, which turns through the year with the seasons; the availability of some dishes also depends on the day's catch. Prices may change: what is displayed in the dining room prevails.
Allergen and intolerance information is given in good faith and kept up to date. The full documentation is available in the dining room. Please tell our staff about any allergy or intolerance before ordering.
12. Links to other sites
Third-party sites reached through links on our pages, such as social networks or review platforms, are not under our control and we are not responsible for them.
13. Intellectual property
Text, photographs, trade marks and design on this site belong to the owner or are used under licence. They may not be reproduced without written permission.
14. Liability
We work to keep the site available and the information correct, but we cannot guarantee it will be free of interruptions or errors. Nothing in these terms limits the rights the law gives consumers.
15. Governing law and jurisdiction
Italian law applies, without prejudice to the mandatory consumer protection rules of the country where you live. For disputes with consumers, the courts of the consumer’s place of residence or domicile have jurisdiction; in all other cases, the courts of Salerno.
16. Changes
We may update these terms: the version that applies is the one published at the time of your purchase or booking, and the date it was last updated is shown at the top of the page.
